LogMeIn Inc. and Dell Inc.

On Sept. 8, 2010 we filed a lawsuit in the Eastern District of Virginia, against LogMeIn Inc. and Dell Inc. alleging infringement of our '479 Patent. We sought past damages going back to Aug. 9, 2005 as well as a permanent injunction against both Dell and LogMeIn prohibiting infringement. On Dec. 15, 2010 we entered into a settlement agreement with Dell, whereby Dell has discontinued the Dell Remote Access products and services accused of infringement. On Apr. 1, 2011 the judge granted LogMeIn's summary judgment motion for non-infringement and removed the case from the court's trial calendar. We appealed that judgment to the United States Court of Appeals for the Federal Circuit and on July 31, 2012 an Order was issued by that court which vacated the district court’s summary judgment of non-infringement and remanded the case back to the district court for trial which commenced March 18, 2013 with the Jury rendering its verdict concluding that LogMeIn does not infringe 01 Communique's patent. The Jury also concluded that 01 Communique's patent is valid. 01 Communique disagrees with the finding of non-infringement and has filed an Appeal with The United States Court of Appeal for The Federal Circuit which issued its Order on June 9, 2014 affirming the district court's finding that LogMeIn did not infringe 01 Communique's patent while also affirming the district court's finding that the patent is valid.
